North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to falls from elevation:
1)Employer failed to provide a working surface free from
recognized hazards in that workers were exposed to falls
through skylight openings that were not properly guarded by a
standard railing or standard skylight screen. [Reference 29
CFR 1926.500(b)(4)].
Eleven H2A workers hired to perform agricultural activities
were working on a warehouse roof and were exposed to fall
hazards.
Among other methods one feasible and acceptable method of
abatement is to install a standard railing, skylight screen,
or some other skylight cover capable of withstanding 200
pounds of direct force.
OR IN THE ALTERNATIVE:
29CFR1926.500(b)(4):  Skylight opening(s) were not guarded by a
fixed standard railing or an adequate cover:
1)Employer failed to guard skylight opening with a standard
guard rail or cover capable of withstanding 200 lbs of force.
Eleven H2A farm workers painting tobacco warehouse roof with
Cold-Seal were exposed to falls through skylight from height
of approximately 25 feet.

employees were exposed to falls from elevation:
1)Employer failed to provide a working surface free from
recognized hazards in that workers were exposed to falls from
tobacco warehouse roof which had not been adequately guarded
for employees engaged in roofing activities.  Employer failed
to provide on a low-slope roof, with unprotected sides and
edges 6 feet (1.8 m) or more above lower levels shall be
protected from falling by guardrail systems, safety net
systems, personal fall arrest systems, or a combination of
warning line system and guardrail system, warning line system
and safety net system, or warning line system and personal
fall arrest system, or warning line system and safety
monitoring system. [Reference 29CFR 1926.501(b)(10)].

nets, personal fall arrest system or any other fall
protection.

North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to: fall from elevation
1)Employer failed to provide adequate training for H2A farm
workers who had been assigned by the employer to paint a 25
foot high roof of a tobacco warehouse. [Reference 29 CFR
1926.503(a)(1)].
Among other methods one feasible and acceptable method of
abatement is to conduct an adequate training program in a
language which the hispanic H2A farm workers understand.
Included in the training should be an opportunity for workers
to discuss and ask questions with regard to the training
program.
OR IN THE ALTERNATIVE:
29 CFR 1926.503(a)(1):  The employer shall provide a training
program for each employee who might be exposed to fall hazards. The
program shall enable each employee to recognize the hazards of
falling and shall train each employee in the procedures to be
followed in order to minimize these hazards.
1)Employer failed to adequately train H2A farm workers to
paint the roof of a 25 foot high tobacco warehouse with Cold-
Seal waterproofing paint.
