Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to:
a)  On June 3, 2003 Pir Tano Construction Company, Inc. permitted
employees to access areas
in-line with the rotating saw blade of a Target Pro 65 III walk behind
pavement saw.  This
activity exposed employees to a struck-by hazard from pavement debris and
machine parts.
Among other feasible and acceptable abatement methods to correct this
hazard include
compliance with:
1)  Diamant Boart (manufacture of the Target Pro 65 III) operating
instructions that require
clearing the work area of employees unnecessary to the saw operation and
not permitting
employees to stand in front of or behind the blade while the engine is
running.
2)  The Concrete Sawing & Drilling Association Specification No
CSDA-F-102,4.4:  Allow no
personnel to be in-line with the blade while it is rotating.
Abatement documentation is required for this item in accordance with the
requirements of 29
CFR 1903.19(d).
