Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to the hazard of falling from an elevation while working from the raised forks of a forklift truck: a. Warehouse area. On or about June 4th, 2004 an employee was lifted on the forks of a Baker forklift exposed to a fall hazard. Among others, one feasible means of abatement would be to use a commercially manufactured safety basket that is specifically designed for use on powered industrial trucks and meets the requirements on ANSI - ASME Standard B56.1- 2000. CORRECTED DURING INSPECTION.s
