Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to death and serious injuries from a substandard suspended
unguarded platform.
Elevated work platforms used with Rough Terrain Forklift Trucks as
designated by the
manufacturer must meet design, construction, and use requirements as
outlined by American
National Standard Institute ASME/ANSI B56.6 Safety Standards for Rough
Terrain Forklift
Trucks Section 5.15.1 (k): restraining means such as railings, chains,
cables, harness(s) with
lanyard(s) were not in place or properly used. Also ASME B56.6 2002
section 8.24.1(b):
Platform width was greater than 10 inches past the width of the load
bearing tires on either side.
(a)On July 30, 2004, employees of Kwaterski Construction, Inc. were
working on an
elevated platform extended by a Gehl 553 Lift, all-terrain lift which did
not meet the
design and use requirements of ASME B56.6 Section 5.15.1 (k) in the
following area:
1)  On the rough terrain fork lift the guardrail were missing on the
pallet used as work
platform exposing employees to a full hazard.
2)  The work platform extended more than 10 inches past the load bearing
tires on each
side.
Among other methods, feasible and acceptable means to correct these
hazards are to use a safer
alternate method such as the use of a platform approved by the manufacture
meeting the
requirements of ASME/ANSI B56.6-2002 for the attachments on rough terrain
lifts and ensure
the appropriate size for the working platform.
No Abatement Certification or Abatement Documentation required.
