Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to death or serious multiple injuries from fall hazards,
inadequate training, and
maintenance deficiencies when using an improper basket platform on a rough
terrain forklift:
Elevated work platforms used with Rough Terrain Forklift Trucks as
designated by the
manufacturer did not meet the design, construction and use requirements as
outlined by
American National Standard Institute ASME/ANSI B56.6-2002 Safety Standards
for Rough
Terrain forklift Trucks Section 5.16.1:  Operators of rough terrain
forklift trucks were not
qualified as to a visual, auditory, physical, and mental ability to
operate the equipment safely
according to para. 5.17 and all other applicable parts of Section 5.
Second, ASME/ANSI B56.6-2002 Section 6.5.1.1:  The rough terrain forklift
truck was in need
of repair and unsafe, or contributes to an unsafe condition, the matter
was not reported
immediately to the user's designated authority, and the truck was being
operated before it had
been restored to a safe operating condition.
Third, ASME/ANSI B56.6-2002 Section 8.24.1 (b):  The floor dimension
exceeded two times
the load center distance listed on the rough terrain forklift truck
nameplate, measured parallel
to the longitudinal center plane of the truck.
Fourth, ASME/ANSI B56.6-2002 Section 8.24.1 (h):  A means to securely
attach the platform
to the lifting mechanism, and to prevent the platform from inadvertent
pivoting was not
conducted.
(a)On August 17, 2004, an employee of Lackie Rentals & Remodeling Inc. was
operating
a SkyTrak 8042 without formal training to educate the employee on the
needed
visual,
auditory, physical, and mental ability required to operate the equipment
properly.
(b)On August 17, 2004, a SkyTrak 8042 was observed with two tires in need
of repair
being used to lift employees on the elevated platform.
(c)On August 17, 2004, employees of Lackie Rentals & Remodeling, Inc. were
exposed to
a fall hazard an approximately 14 feet to ground on a work platform 16
feet long that
exceeded two times the load center distance listed on the rough terrain
forklift truck
nameplate.
(d)On August 17, 2004, employees of Lackie Rentals & Remodeling, Inc. were
exposed to
a fall hazard approximately 14 feet to ground with the work platform not
secured to the
rough terrain forklift.
Among other methods, feasible and acceptable means to correct these
hazards
are to use a safer
alternate method such as the use of a platform approved by the manufacture
meeting the
requirements of ASME/ANSI B56.6-2002 for the attachments on rough terrain
forklifts, securing
the platform, repairing the worn tires, and properly training the
employees in the required
elements.
