Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazard/death from unsecured loads on the forks of a rough terrain fork lift: The Rough Terrain Forklift was not used as outlined by American National Standard Institute ASME/ANSI B56.6-2002: Safety Standards for Rough Terrain Forklift; Section 6.4.3: Handle only stable and safely arranged loads. Handle loads exceeding the dimensions used to establish rough terrain forklift truck capacity with extra caution. Also, section 6.2.7.: Do not allow anyone to stand or pass under the elevated portion of any rough terrain forklift truck whether empty or loaded. (a) On May 12, 2005, the owner of Cornerstone Construction did not ensure that a 24 foot long laminated beam was stable and safely arranged (secured) to the forks of the rough terrain forklift truck. Also, special precautions were not taken when the beam lifted was heavy and long exceeding the stability dimensions the truck capacity. (b) On May 12, 2005, the owner of Cornerstone Construction did not ensure that employees were clear of the suspended load and did not allow anyone not to stand or pass under the elevated portion of any rough terrain forklift whether empty or loaded. Among other methods, feasible acceptable means to correct these hazards are to make sure that the loads are secured on the rough terrain forklift while lifting and to make sure that no one is under any loads while lifting, as referred in the Rough Terrain Forklift Standards (ASME B56.6- 2002). No Abatement Certification or Abatement Documentation required.
