Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls or possible amputation from working inside a trench, in a bucket attachment of an excavator. (a) On 5/25/05, employees worked inside a bucket attachment of the excavator, exposing employees to a crushing injury between the bucket and the trench wall. This operation did not conform with the "Construction Industry Manufacture's Association (CIMA): Section 16;" Never allow anyone to ride the attachment or the load". Among other methods, feasible and acceptable means to correct the hazard by use of pump or other collection device to remove the water accumulation in a properly sloped, shored or otherwise protected area in a trench. No Abatement Certification or Abatement Documentation required.
