Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by a trash container bucket mounted on a
front loading refuse truck
while truck was going through its dumping cycle:
a.Waste hauling pickup route, Church Rd, Bedford, NH - On 5/6/05, an
employee
working beneath a trash container bucket did not have adequate safe
operating
procedures to prevent employee from being struck by the container during
dumping cycle.
ABATEMENT NOTE:  One feasible means of abatement, among others, would be to
establish safe operating procedures and to instruct and train drivers and
helpers to ensure
that persons are away from container lifting devices and containers during
all phases of
the operation and ensure that there is adequate clearance for the
operation
before
activating any container lifting device.
Other feasible controls include using a sensing device that would stop the
descent of the
lifting device if an obstacle is in the way and an audible alarm that
would warn the
helper if the lifting device is moving.
