Section 5(a)(1) of the Occupational Safety and Health Act of 1910: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the condition(s) listed below:
Parmer County Cotton Growers Co-Op, 340 U. S. Highway 84, Farwell, Texas;
For the
period of time up to and including December 15, 2005, the employer did not
provide forklift
training according to the National Fire Safety Code. The employees
operated a Nissan
Forklift, Serial #55F-SSS-A971, to load bales of cotton on a flat bed
truck.
This condition exposed employees to potential struck by hazards which can
cause injuries
such as, but not limited to, broken bones and potential death.
Under the National Fire Safety Code (NFPA 2006), Article 8.6.1 states
"There shall be a
written operating procedure plan and operator training relevant to the
location of use and
type of truck.Under the National Fire Safety Code (NFPA 2006), Article

shall be a written operating procedure plan and operator training relevant

Under the National Fire Safety Code (NFPA 2006), Article 8.6.2 states "The
procedure shall
include, as a minimum, the following:
(1)     Operation limited to trained personnel
(2)     Cautions where checking or filling tank
(3)     Action for suspected leak
(4)     Refueling instructions
(5)     Emergency items
(a)     Shutoff fuel valve
(b)     Correct battery type and position
(c)     Fire emergency procedures
(6)     Hazardous location classifications and markings
(7)     Industrial truck designations and markings
One feasible and acceptable abatement method would be to provide forklift
training
to all
employees who operates a forklift.
NOTE: Abatement certification and supporting documentation are required
for this item.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the condition(s) listed below:
Parmer county Cotton growers Co-Op, 340 U. S. Highway 84, Farwell, Texas;
For the
period of time up to and including December 15, 2005, the employer did not
ensure that the
stairs used for employees to enter the tool room had a standard railing on
the open sides.
This condition exposed employees to fall hazards which can cause injuries
such as cuts,
abrasions, and broken bones.
Under the American National Standard A12.1 1973, paragraph 6.1 (4) states
"On stairways
44 inches wide but not exceeding 88 inches wide, one handrail on each
enclosed side and one
stair railing on each open side.
One feasible and acceptable abatement method would be to ensure all
stairways with 3 or
more risers are in compliance in accordance with A12.1 of the American
National Standards.
