Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to fall hazards of up to approximately 12 feet to the paved ground surface below when working from an elevated work platform attached to the forks of a rough terrain forklift truck: (a)At the job site, an employee was exposed to serious injury or death created by the use of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of ASME/ANSI B56.6a-1994: Safety Standards for Rough Terrain Forklift Trucks, Section 8.25, Platforms for Elevating Personnel, in the following areas: (1)Paragraph (b) which states, "floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a width greater than the overall width of the truck [measured across the load bearing tires plus 10 in. (250 mm) on either side]." In this case, the forklift personnel platform extended a total of forty-seven (47) inches beyond the wheelbase of the truck (twenty-three and a half (23.5) inches per side). (2)Paragraph (f) which states, "information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform." In this case, none of the information listed above was marked on the forklift platform at the time of the inspection. Among other methods, feasible and acceptable abatement method to correct this hazard is to use a scaffold system, or ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ANSI B56.6a-1994.
