Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to a crushing hazard from moving parts: (a) On or about July 26, 2005, the employer did not ensure that employee(s) loading cars onto a Boydstun car hauling trailer, utilized retaining pins in the ramp and rack frame to prevent unintended movement or collapse in the event hydraulics failed or an unintended engagement of hydraulic controls occurred. This exposed the employee(s) to a crushing hazard. A feasible means of abatement includes, but is not limited to, developing written procedures to ensure the use of retaining pins is understood and periodically reviewed by the employer, that the retaining pins are in place at all times when working within the framework of the car hauler and that the hydraulic controls are safe guarded from unintended operation from the inside of the trailer framework. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.
