North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of
North Carolina: The employer did not furnish to each of his employees
conditions of
employment and a place of employment free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees, in that
employees were exposed
to being struck by stored materials falling from the shelving::
a)site, warehouse, oil bay room - multiple metal storage racks, Reliable
Upright,
model #RU27420216 and Reliable Beam, model #RBN55144, 2 shelves high,
with 1 shelf each set at approximately 79 inches and 158 inches above the
concrete floor,  where vertical legs/footings were not appropriately
secured to
the floor with 2 metal bolts, but had only one bolt attached and in place,
and
exhibited visible stress and bend/twist in the legs, along with visible
stress and
obvious bend/flex in the shelves causing 3 unsecured and unrestrained
pallets
weighing up to approximately 2300 - 2400 pounds each (total weight of
approximately 6900 lbs) to lean and tilt in an unbalanced manner on beams
rated at 4800 lbs total maximum weight.
One feasible and acceptable abatement method, among others, to correct this
hazard is to post the maximum load capacity allowed and test the loads to
insure that the maximum load capacity is not exceeded; and/or replace the
metal storage racks and/or necessary components with equipment which
clearly
exceeds the facilitys highest known and/or intended load.
