Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, employees were exposed to the recognized hazard(s) that were causing or likely to cause death or serious physical harm in the following instances: a.The Datsun/Nissan forklift used for unloading sheets of metal at the loading dock was not equipped with a restraint device (seatbelt) as required. b.The Daewoo forklift located in the shear area used for moving materials within the facility, was not equipped with a restraint device as required. These conditions exposed employees to the hazard of being struck by the forklift in the event of a roll/tip-over accident. Among other methods, feasible and acceptable abatements methods include, but are not limited to: 1.Installation of seatbelts on the forklifts. 2.Communicate hazards to employees concerning forklift tip-over accidents. 3.Train employees in the requirements of seatbelt use. 4.Enforce the use of seatbelts while operating powered industrial trucks.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, employees were exposed to the recognized hazard(s) that were causing or likely to cause death or serious physical harm in the following instances: a.The foot pedal of the Chicago press brake was not provided with a means to prevent accidental actuation of the press. b.The foot pedal of the Niagara press brake was not provided with a means to prevent accidental actuation of the press. These conditions exposed employee(s) to the hazard of being caught in the point of operation. Among other methods, means of feasible and acceptable abatement methods include but are not limited to: 1.Removing the pedal and placing it in a safe location. 2.Providing a locking pin or locking lever. 3.Guarding the pedal with a protective cover (and guarding any exposed treadle-bars or linkages which could inadvertently trip the press. Disclaimer: 1.The employer is not limited to the abatement methods listed. 2.The listed abatement methods may not be effective in all circumstances. 3.The employer is responsible to determining the most effective abatement method.
