Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to Mycobacterium tuberculosis:
a) Ocean Care Center (emergency department, curtained off treatment area)
- Employees
were exposed to a case of suspect tuberculosis (later confirmed as active
TB) in that
respiratory acid-fast bacilli (AFB) isolation room was not promptly made
available.  On
or about April 9, 2004, 2004.
Feasible and useful abatement methods for reducing this hazard, as
recommended by the
CDC, include, but are not limited to:
Enhance the TB control plan by working in conjunction with other medical
care
facilities in the area to develop procedures for promptly transporting
suspect
TB
patients from the emergency department to facilities with vacant AFB
isolation
rooms.  Add any provisions to the written TB control plan, then train
employees
on these new provisions.
Train employees on the availability and location of portable ventilation
units,
equipped with HEPA filters, and on the urgency of operating one of these
in an
area housing a suspect TB patient as interim measure until an AFB
isolation room
is made available.
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE
TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29
