Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that; employees were exposed to bolts of lightning that were
striking all around
the worksite:
(a) On or about October 19, 2004 - The employees working in the trench and
operating
the backhoe were not protected from lightning strikes occurring on the
jobsite as they
continued to work during the lightning/thunderstorm, with lightning
striking very close
to the jobsite.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to develop an emergency action plan that removes employees from
the danger
area when a lightning/thunderstorm approaches, before the first lightening
strike
occurs
in the work area.
