General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish to each of his employees
employment and a place of employment which were free from recognized
hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to:
(a) Site, Southwest side of building - Employees were using an Ingersoll
Rand rough terrain forklift as a
personnel lift while landing rails on the 3rd floor balcony. This clearly
violates ASME B56.6 which states
this type of equipment may be used only if no other practical means are
available.
Among other methods, a feasible and acceptable method of abatement is for
railings to be landed on the
balcony using the forklift alone and then having employees reposition or
install the rails while working from
the balcony.
