Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by a Jib Crane Hoist
and supporting
system.
a.  On or about November 26, 2003, employees were exposed to the hazard of
being struck
by a falling Jib Crane Hoist and supporting system during the process of
flipping and then
lifting a beam.  The hoist supporting system failed and the Jib Crane
Hoist and supporting
system fell downward and struck an employee working on the floor.
One feasible and acceptable abatement method among others, to correct this
hazard is to
install all Jib Crane clamps, hangers rods, bolts, suspension fitting and
supporting structure
to withstand load and force imposed by the hoist rated load.  The hoist
rope
or chain shall
not be wrapped around the load and the load shall not be picked up in
excess of the rated
load appearing on the hoist or load block in accordance with the American
Society of
Mechanical Engineers (ASME) B30.11-1998 Section 11-1.3.2 and ASME
B30.16-2003
Section 16-1.3.2, and 16-3.1.2 a, h.
