Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about January 21, 2004, employees were exposed to the hazards associated with powered industrial trucks being used without the benefit of seat belts, thereby exposing employees who operates the Caterpillar forklift truck, serial number 2ND01127, and the Hyster 50 forklift truck, serial number C187V05519P, to the hazards of being struck by a falling fork truck if it tip over. One feasible to correct the hazard is to ensure that restraining devices (seat belts) are installed on the forklifts in accordance to ANSI/AMSE B56.1a-1989.
