Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about February 27, 2004 - at the above addressed jobsite , the bucket of the John Deere 330LC Excavator was used as a working platform fo r an employee performing cutting operations on the existing sea wall. Among othe r methods, feasible and acceptable abatement methods include, but are not limite d to the following: a. Follow the Equipment Manufacturers Institute safety manua l for operators and mechanics of hydraulic excavators which states "Never use a bucket for a work platform or personnel carrier", and b. Follow the John Deere O perators Manual for 330LC and 370 Excavators which states "Only allow the operat or on the machine. Keep riders off."
