Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)Precision Construction West, Inc., at 1600 Mountain Sky Lane, Granby, CO: On or before May 7, 2004, the exposing employer did not ensure that employees were provided a work platform designed for safely elevating personnel. An employee was working off the plywood platform on the elevated forks of the CAT Wagner, Rough Terrain Forklift, performing carpentry operations on the new house under construction. This condition exposed the employee to the hazard of falling approximately 15 feet. Among other methods, one feasible and acceptable abatement method to correct these hazards is to follow ASME/ANSI requirements associated to lifting personnel as outlined below: (a)Only operator-up high lift trucks have been designed to lift personnel.
