North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)maintenance shop - for the Budget 2 ton underhung crane that was not load tested prior to use. maintenance shop - for the Budget 2 ton underhung crane that was not marked with the load capacity. Ref. ANSI B30.11-1980, paragraph 2.2.2. Abatement Note: One feasible and acceptable abatement to correct this hazard is to do a load test and mark the rated load on the crane.
