Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while climbing to and from a work location when using a fiberglass ladder. a) Among other methods, one feasible and acceptable method to correct this hazard would be to use a ladder of the sufficient height which does not require the use of the top step. Adhere to the manufacturer's label marking the highest standing level of the ladder that does not permit an employee to stand on the top step of the ladder as specified in the American National Standard for Portable Reinforced Plastic Safety Requirements(ANSI A14.5-1992), Section 9.3.2 Climbing and Working Location. DISCLAIMERS: 1) You are not limited to the abatement method suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method of abatement.
