Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling from, getting struck by or being crushed by a
scissor as the employer
did not comply with ANSI A92.6-1990:
At the Kohl's Distribution Center construction project in Macon, Ga. on or
about 10/13/04,
(a)Employees operating the Marklift J19EP were not able to refer to the
operating
and maintenance manual as the employer did not keep or maintain the
manual(s)
required in section 4.16.1.
(b)A preventive maintenance program had not been developed for the company
owned Marklift J19EP.  The Marklift J19EP had not been inspected and
serviced
by a qualified mechanic who has specific knowledge of the Marklift J19EP.
The
lift had plain view defects and structural defects at the time of the
inspection. The
employee operating the lift was catapulted out of the lift when the
bracket, roller
support and wear pad became separated from the lift.  The manufacturer and
ANSI A92.6 require a preventive maintenance program.
(c)The employer had not caused a frequent inspection to be performed on
the scissor
lift.  The inspections are to be performed every three months or 150 hours
whichever comes first or prior to returning to service after being out of
service
for three months or more.  Such an inspection would include a visual
inspection
of the structural components and other critical components such as
fasteners, pins,
shafts and locking devices;
(d)The employer had not caused an annual inspection of the lift by a
person qualified
as a mechanic on the Marklift J19EP.
Among other methods, feasible and acceptable abatement methods to correct
this hazard are:
(a)to obtain a copy of the manual from the manufacturer;
(b)to develop and implement a preventative maintenance plan for all
company owned
lifts as specified by the manufacturer and ANSI A92.6-1990 section 6.3.
(c)to cause frequent inspections to be performed by a person qualified as
a mechanic
on the specific make and model of the aerial platform.  The inspection
shall
include all items specified by the manufacturer and ANSI A92.6-1990
section 6.5.
Retain written records of frequent inspections for a minimum of three
years.  The
record shall include the date of the inspection, deficiencies found,
corrective
action and identification of the person(s) performing the inspection and
repairs.
(d)to cause annual inspections to be performed by a person qualified as a
mechanic
on the aerial platform.  Retain written records of annual inspections for
aminimum of three years.  The record shall include deficiencies found,
corrective
action and identification of the person(s) performing the inspection and
repairs.
