5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that on 05/21/04 an employee was exposed to crushing and amputation hazards from falling debris, while conducting pounding operations in the parking garage to loosen concrete debris from overhead. One feasible and acceptable abatement method to correct this hazard would be; have an engineering survey done by a competent person, as described in 29 CFR 1926.850 Preparatory Operations for demolition. The survey should be done using concrete sounding techniques and visual inspections to identify and mark the extent of the damage, and have it removed by trained personnel in accordance with concrete construction industry standards.
