Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment free from recognized hazards that were
causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to injuries and/or
death from falls:
Smokehouse Area:   Employees used a ten (10) foot fiberglass
self-supporting ladder
(step ladder) as a single ladder and leaned it against the smokehouse wall
to access
and/or carry parts to the top of an eleven (11) foot tall smokehouse
during installation
of the oven.
Among other methods, one feasible and reasonable method to correct this
hazard is to
use the ladder in accordance with the American National Standard for
Ladders - Portable
Reinforced Plastic-Safety Requirements, ANSI A14.5-2000, section 9.3.1.2
which states,
"Self-supporting ladders shall not be used as single ladders or in the
partially open
position.
There is no abatement certification or documentation required for this
item.
