Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that incompatible chemical storage and possible mixing of combustible liquids with oxidizing chemicals could result in employees being exposed to chlorine and/or a fire hazard: or in the alternative, 29 CFR 1910.1200(h)(3)(ii): Employee(s) training did not include the physical and health hazards of the chemicals in the workplace: a. Building 2 - On or about 11/16/04 a drum of hydrogen peroxide(oxidizer), a drum of tri-chloro- ethylene(Class 1C flammable & poison) and a drum of sulfuric acid(acid) were stored adjacent too each other and among other drums of combustible materials (D-Limonene & Polysorbate 80). On 2/16/05 a drum of Quat 256(corrosive) was stored next to tri-chloro-ethylene(a poison). Inadvertent mixing of these chemicals could result in exposure to chlorine as well as pose a fire hazard. Among other methods, one feasible and acceptable method to correct this would be to physically separate the incompatible materials in separate areas or storage rooms. Abatement certification is required within 10 days after the abatement date. The certification shall include a statement that abatement is complete, the date and the method of abatement, and a statement indicating employees and their representatives were informed of this abatement.tives
