North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from an unprotected operator's platform of a powered industrial high lift truck: a)facility, printing department - where the employer used a HYSTER R30C, S/N B118U1931B, high lift truck for retrieving and delivering materials to the second floor of the facility without providing any type of fall protection system for the operator who rides the operator's platform to approximately 15 feet above the lower level. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide, install and use an appropriately designed fall protection safety harness attached to a short, 5-foot or less, retractable lifeline device mounted to the truck's overhead protection frame. Reference: ASME B56.1-1993, Paragraph 4.17.2(c): "...be certain that required restraining means such as railings, chains, body belt(s) with lanyard(s), or deceleration devices, etc., are in place and properly used."ly
