Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to:the hazard of falling off of the dirt-work attachment of a Bobcat Skid-Steer including striking the ground and being run over. At 13981 Eastgate Drive, Rogers, Arkansas: An employee of O. G. Dirtworks was exposed to injury while riding atop the dirt-work attachment of a Bobcat 873Skid-Steer as it transported the employee and a wheel barrow, which was also atop the attachment along Eastgate Drive to the jobsite. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to Among other methods, one feasible and acceptable method to correct this hazard is to require and effectively enforce the rules of operation recommended for by the manufacturer and to provide in depth training for all personnel required to use the Bobcat Skid- Steer, including hands- on training and supervised on-the-job training, prior to employees being permitted to use the equipment.
