Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious phyical harm to
employees in that
employees were exposed to:
(a) The hazard of being struck by a load that was lifted by a 1963 12.5
ton Bay City truck
mounted crane on or about November 9, 2005 when the manufactures
specifications and
limitations for the Crosby 10 ton hoist block were exceeded at the
construction site located
on West Reeder Street; Dillon, Montana.
One feasible and acceptable abatement method to correct this hazard is to
follow the
manufacturer's specifications for maximum capacity load rating for the
hoist block.
