Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
the recognized hazard of being crushed by a Komatsu powered industrial
truck, model FG-25
T-11, serial # 253600, in the event of a tip over at the facility located
at 519 E. Walker, League
City, Texas or traveling down a public road.
Among other methods,one feasible and acceptable abatement method is to:
employ the use of an operator restraint system as outlined in the American
Society of
Mechanical Engineers (ASME) B56.1-2000, Safety Standard for Low Lift and
High Lift Trucks,
Section 5.3.19.
