Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which were free from recognized hazards that was causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or crushed by while dismantling a 60 foot, Link-Belt Crawler Crane, Model No LS-98, Serial No 9LR 2525. The 60 main boom was improperly disabled on or about 09/21/05, at HWY 517, Southview, Dickinson, TX. The employee was under the boom removing the pins, the boom fell and crushed the employee. Among other methods,one feasible and acceptable abatement method to correct this hazard is to (1) support or secure the boom against falling as specified by The American Society of Mechanical Engineers (ASME) B30.5 - 1968.(2) implement the instruction of Essential Safety Precautions for Boom Lowering and Disassembly as specified in American Crane Corporation( Chapter 7 Para II-A Thru A-7, Pg 699.8-Pg 699.9) DISCLAIMERS:1) You are not limited to the abatement methods suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selection and carrying out an appropriate abatement method.
