Section (5)(a)(1) of the occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free of recognized
hazards that
were causing or likely to cause death or serious physical harm to
employees in that an
employee was exposed to a fall hazard:
On or about 11/02/04:
a)  Manchester Township Water Tower, Rt. 37, Manchester Twp., N.J. -
Employee
was exposed to a fall hazard while standing on the top rail of a personnel
man basket.
The employee was holding the man basket against the tank that they were
working on.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is
to:
1) Ensure employee(s) always stand on the floor of the personnel man
basket.
2) Secure personnel man basket to structure.
