Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about  November 18, 2004, employees were exposed to the hazard of
being crushed due
to the D6M Bulldozer not being shut down properly when left unattended and
for allowing
unauthorized personnel on the machine.
Among the methods, one feasible and acceptable method to correct this
condition would be to
follow the Crawler Tractor/ Loader safety manual, for operating and
maintenance personnel
from the Construction Industry Manufacturers Association and to follow the
Caterpillar
Manufacturers recommendations for Operation and Maintenance of D6M
Track-Type tractors.e
