Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard:
a) Construction site located at 300-302 East McFarlan Street, Dover, NJ.
Employer failed to implement a procedure to ensure that the swing radius
of the excavator was
guarded.
Violation occurred on or about 04/07/2005.
"Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to guarded swing radius of the excavator. Develop and implement a
walkaround checklist to
ensure that the operator check to see if his swing radius is guarded
before
starting to work.
