Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
was free from
recognized hazards that were causing or likely to cause death or serious
physical harm in that
employees were exposed to the hazard of caught-in-between due to an unsafe
work practice
of riding the back of a skid steer:
On or about February 14, 2006, employees were exposed to the hazard of
caught-in-between
the pinch point of the hydraulic arms of a skid steer.
Among other methods, one feasible and acceptable means to abate this
hazard is to institute
safe work practices in accordance with the John Deere Operators Manual for
the 7775 Skid
Steer.  The manual covers training, signage, decals and the safe operation
of the equipment.
The manual can be used to assist the employer in training/retraining all
personnel (operators
as well as non-operators) in the recognition and avoidance of unsafe work
conditions
or
hazards when working around machinery, such as but not limited to, a skid
steer.
OR IN THE ALTERNATIVE OF:
29 CFR 1926.21(b)(2):  The employer shall instruct each employee in the
recognition and
avoidance of unsafe conditions and the regulations applicable to his work
environment to
control or eliminate any hazards or other exposure to illness or injury:
On or about February 14, 2006, employees were exposed to the hazard of
caught-in-between
the pinch point of the hydraulic arms of a skid steer.  The employer did
not train employees
in the recognition and avoidance of unsafe work conditions or hazards when
working around
machinery.
