Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to: being thrown from and being
crushed by earth-
moving equipment due to employees' failure to wear seat belts.
(a)Saint Andrew's Episcopal Lower School, 4120 Old Canton Road, Jackson,
MS -
On Friday, July 1, 2005, the employee operating the Case 580-K
Tractor/Backhoe was
not wearing the seat belt.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
for the employer to enforce the wearing of seat belts on all earth moving
equipment.
