T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to:
In that the employer did not ensure that all employees wear their seat
belts while operating
powered industrial trucks.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to provide training/re-training on the requirements for seat belt
use while operating
powered industrial trucks, and enforcement of disciplinary action for
employees observed not
wearing seat belts while operating such equipment.
