Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) Case Pack Module, 2nd level, On or about October 17, 2006 - Case pack associates were working on the second level of the case pack modules, at heights of approximately 8 feet, with no fall protection systems in place to prevent them from hazards of falling to the floor below. Among other methods, one feasible and acceptable abatement method to correct this hazard is: To provide standard fall protection to prevent fall hazards, by placing guard rails on the outer portion of the module, or provide fall protection for employees while working in the module. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
