Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to suspended loads held by overhead hoists that were not periodically inspected: a)Hitch area, south end; Employees were exposed to the hazard of being struck by falling loads, such as sections of metal, by using two Coffing 1 ton underslung cranes that had not been inspected with a periodical inspection (at least every 12 months) to determine wear, deterioration and malfunction as per ANSI B30.16-1. Both cranes had the safety latches missing from the load hooks.
