Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to:
a)site, Crystalwater Drive - on or about 08/15/06, an employee was
observed riding in the
bucket of a bobcat, Ingersoll-Rand, model #863, while it was being driven
by the jobsite
foreman along a paved, public street, within a residential sub-division
which was traveled by
passenger vehicles and/or heavy motorized and off-road equipment.
One feasible and acceptable abatement method, among others, to correct
this hazard is to
develop and/or establish written procedures on proper equipment usage,
train employees on
applicable and acceptable established procedures, prohibit employees from
performing and/or
attempting to perform inappropriate and/or unsafe procedures, and enforce
established and/or
applicable policies and procedures for equipment usage.
