North Carolina General Statute 95-129(01) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of
employment free from recognized hazards that were causing or likely to
cause death or serious physical
harm to employees in that employees were exposed to a caught in/crushing
hazard
while riding inside the
loading sill of the hopper of the rear-loading compactor truck and fall
and struck by hazards when riding
on the exterior of the truck while traveling in excess of 35-plus miles
per hour:
a)residential street -  where one employee was standing inside the loading
sill of the hopper
opening while riding from one residential pickup site to the next while
the vehicle
operator exceeded 35 miles per hour for approximately 1/3 mile.
ABATEMENT NOTE:  Among others, one reasonable and feasible method to
reduce this hazard would
be to instruct employees on prohibited practices.

when the vehicle is exceeding 17 kph (10 mph), operating in reverse, or
when
the distance traveled
exceeds 0.3 km (0.2 mi), and; b) "Ensuring that no person(s) ride on the
loading sill or in the hopper of a
compactor equipped vehicle"
b)residential street - where the employer did not identify hazards and
prohibited practices,
did not instruct employees in hazards based on a hazard assessment and did
not ensure
employees remained clear of the danger area as part of the operating
procedures.
ABATEMENT NOTE:  Among others, one reasonable and feasible method to
reduce this hazard would
be to instruct employees on prohibited practices and provide individual
training on specific equipment
which the employee may be expected to encounter.

program must include at a
minimum the following elements; a) A hazard assessment in which the
employer conducts a review of the
various types of collection and transportation equipment which the
employer utilizes and the hazards
associated with them, including sampling or measurements, where
appropriate, to the type of hazard, as
well as the persons who may potentially encounter those hazards;  b) An
evaluation of the means of
controlling the hazards identified in the hazard assessment, including
information such as industry and
regulatory requirements; instructions for the operation, inspection, and
maintenance of equipment; and
literature, surveys, and other information appropriate to the hazards that
are identified; c) A written
program based upon the hazard assessment and evaluation, to include
procedures for the operation,
inspection, and maintenance of equipment, prohibited practices, record
keeping, training requirements and
normative references to documents, such as operating manuals, that are
relied upon and may be required
as part of that program;  d) A program, conforming to clause 9.3, for the
implementation
of the written
program, and e) periodic reviews and program revisions as necessary to
ensure the effectiveness of the
safety program."
