Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.On or about December 13, 2005, at the jobsite located at 2704 North Arkansas, Russellville, AR, an employee was standing on the mid rail of the elevated Sky Jack to perform work. This condition exposed the employee to the hazard of falls from elevation. b.On or about December 13, 2005, at the jobsite located at 2704 North Arkansas, Russellville, AR, an employee was sitting on the top rail of the elevated Sky Jack to perform work. This condition exposed the employee to the hazard of falls from elevation. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a policy that prohibits standing and sitting on guard rails, communication of the policy to the employees and enforcement of the policy.ment
