Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
(a)Highway 21 (North Main St.) Atmore, AL: On February 20, 2006 during
paving
operations an employee standing on the rear deck (pickboard) of the
Road-Tech
Spreader/paver was struck by the Ingersol-Rand DD-130 Compactor (S/N
167676) when the Compactor moved forward pinning him against the ladder of
the spreader/paver and fracturing his leg.
Among other methods, feasible and acceptable abatement methods to correct
the
hazard are to: 1) Follow and adhere to the safe work practices as
described in
Safe Operating Practices for Hot Mix Asphalt (HMA) Construction. ANSI
A10.17-1997, Section 3, Paragraph 3.3.3, (page 2) Operators of
bi-directional,
self-propelled vehicles shall be certain that the travel area is free of
foreign
material, personnel, and vehicles before moving or changing direction. The
operator shall face the direction of travel and use mirrors.
In actual practice all employees should be cleared from the pickboard
(rear deck)
of the spreader/paver when the compactor approaches within 5 to 10 feet.
