Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a limb: location: 1425 Flagler Dr. on or about: 9/28/06 a) An employee was in a tree, cutting limbs. A second employee was standing on the ground below. The employee on the ground was exposed to the hazard of being struck by the falling limb. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Follow paragraph 9.5.5 of the American National Standard for Arboricultural Operations, Pruning, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements, ANSI Z133.1 Revision October 2000, which states: Workers shall be positioned and their duties organized so the actions of one worker will not create a hazard for any other worker. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.ce
