Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by an overloaded Skid Steer Loader: Location: Job Site, 400 Guard Hill Road a) The employer did not train their employees to operate the Skid Steer Loader without overloading it, thus exposing the employees to crushing hazards, on or about 04/03/07. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to... 1. Follow the instructions in the New Holland Lx885 Operator's Manual, Safety Information, Page 0-9, "Warning: Do Not overload! Never Lift More Than The Maximum SAE Load Rating Of The Loader" LX 885 Mfg. Rating is 2200 lbs. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
