North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees, in that employees were exposed to death or serious injury from
a fall from elevation hazard:
a)on or about 09:00 AM on 12/27/05, employee was standing on a wooden
pallet while being
lifted in the air by a forklift, exposing employee to a 20 foot fall
hazard.
Among other methods, one feasible and acceptable method of abatement is to
use the one of
the employer's two scissor lifts located on the job site to lift
employees.
