Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard of falling:
On or about 01/31/06 at Turtle Creek Mall,Barnes & Noble Space 410, an
employee was
exposed to a fall of more than seven feet from a Genie model 1930 scissor
lift platform
because the combination access/midrail gate was wired open. Among other
methods,
feasible and acceptable, to correct this hazard, include but are not
limited to: a) assure
that the combination access/middrail gate is operable and in the closed
position when the
lift platform is in use; b) Conduct training on the safe use of the
scissors lift as per
manufacturer's operating instructions, as specified by ANSI/SIA
A92.6-1999, American
National Standard for Self-Propelled Elevating Work Platform, and (c)
comply with the
Association of Equipment Manufacturers Aerial Platform - Safety Manual for
Operating
and Maintenance Personnel which requires gates or safety chains be
attached and secured
across the access opening for scissor lifts prior to start
up/operation/elevating.
