Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to saws which were not equipped with a magnetic restarter or equivalent device. The Kalamazoo horizontal band saw, was not equipped with a magnetic restart. ANSI B11.10.2003, Section 6.11 states that all machine controls shall incorporate a type of drive motor starter that will disconnect the drive motor from the power source in the event of control voltage or power system failure. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).
