Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Elevated work platforms used with rough terrain forklift trucks as designed by the manufacturer must meet design, construction and use requirements as outlined by the American National Standard Institute ASME/ANSI B56.6-2005, Safety Standards for Rough Terrain Forklift Trucks, Section 5.15.1, which requires; If a rough terrain forklift truck must be used to lift people, the following precautions for the protection of personnel be taken: paragraph (a) provide a personnel platform which complies with the design requirements listed in Part III of this Standard, paragraph (b) be certain that the platform is securely attached to the lifting carriage and forks, paragraph (k) be certain that required straining means such as railings, chains, cable, body belt(s) with lanyard(s), etc., are in place and properly used, paragraph (s) When the operator is not in the operating position, block the truck wheels and apply the parking brake with all travel controls in neutral, and paragraph (w) platform shall be lowered to floor level for personnel to enter and exit. a) On 7/12/07, at the home construction site at 2921 Waubenoor Dr. in Green Bay, WI an employee was working approximately 20 feet above the ground from the platform mounted on the forks of the Lull 644B-42 which did not meet the design and use requirements of ANSI/ASME B56.6 2002 in the following areas: 1. The platform was not secured firmly to the lifting carriage and the forks; the platform was secured only be means of nylon tie down straps wrapped around the platform and forks. 2. Guardrails were missing from the platform. 3. The employee working from the platform exited the platform without lowering it the ground level. 4. The wheels of the Lull were not blocked when the machine was parked behind the house on a slope and no one was attending the controls. 5. The platform was designed so that it could be centered longitudinally on the forks. Part III of this Section 8.24.1(g) requires a means so that the platform can only be centered laterally on the forklift truck. Among other methods, feasible and acceptable abatement means to correct these hazards are to use a platform meeting the requirements of ANSI/ASME with guard rails, ensure that the platform is oriented laterally on the forks, and securely attached, and to lower the platform to the floor level prior to entering or exiting the platform. Abatement Certification and Abatement Documentation required.
