Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard from being struck by the skid steer that
was parked on and
incline.
(a) On September 16,2008 an employee was shoveling dirt from the bucket of
the New Holland
LS180 skid steer that was parked on an incline of approximately 35grade.
The wheels were
not blocked and the bucket was off the ground.
Among other methods, feasible and acceptable means to correct these
hazards are to
ensure that the skid steer is operated according to manufacturer's
recommendations.  The
operator's manual states, "When parking the skid steer on any slope,
engage the parking
brake and block the wheels."  It further states, "Never exit the skid
steer
unless the boom
and attachment are down resting on the ground or the boom is resting on
the boom lock
pins."
